Disclaimer Out of the sun in Spain

TERMS & GLASS DISCLAIMERTERMS & GLASS DISCLAIMER

This disclaimer governs all solar, privacy, and safety window film installations provided by Out of the Sun Spain. By accepting our quotation, invoice, or permitting installation work to proceed, the customer acknowledges and accepts the conditions outlined below, subject to applicable Spanish consumer and contractual law.

Product Selection & Installation Standards
  • Out of the Sun Spain exercises every reasonable professional care to evaluate existing glass surfaces and select the correct solar, privacy, or safety film for your specific application. Installation is performed using standard industry methods appropriate for the selected film and glass type.
Glass Characteristics & Thermal Stress

  • Existing glass units may contain hidden structural stresses, manufacturing imperfections, edge damage, or pre-existing weaknesses that cannot be identified through visual inspection.
  • Applying window film alters the thermal absorption and radiant energy balance of glass. While solar control film is engineered to manage solar energy, glass can break due to thermal shock, structural shifts, frame pressure, or unrelated non-visual defects.

Limitation of Liability for Glass Breakage

  • Post-installation glass breakage does not, in itself, demonstrate that the window film or installation process caused the failure.
  • Out of the Sun Spain accepts no liability or financial responsibility for hidden, pre-existing, or undetectable defects in existing glass units.

Safety & Security Film Performance

  • Safety and security films are designed to hold glass fragments together upon impact or failure to mitigate injury risks and hinder unauthorized entry.
  • Safety film application does not render glass completely unbreakable, nor does it guarantee absolute prevention of burglary, forced entry, or accidental damage.

Issue Resolution & Discretionary Contributions

  • If an unexpected breakage or issue occurs, Out of the Sun Spain will work with the client in good faith to examine the circumstances and seek a fair solution. Where appropriate, an independent technical assessment may be advised.

Any goodwill contribution, allowance, or assistance offered toward repair or glass replacement is strictly discretionary and does not constitute an admission of fault or legal liability.
